These Terms and Conditions (“Terms”) apply to all tattoo and related services provided by Ink By Jay (“we,” “us,” “our”) and to your use of our website (if applicable). By booking an appointment, paying a deposit, or receiving our services, you agree to be bound by these Terms.
Eligibility
You must be at least 18 years old to receive tattoo services in the State of Utah. A valid government-issued photo ID is required at your appointment to verify your age.
Booking, Deposits, and Cancellations
A non-refundable deposit is required to secure your appointment. The deposit amount will be confirmed at the time of booking and applied toward your final tattoo cost.
If you cancel or reschedule with less than 48 hours’ notice, your deposit will be forfeited.
For larger tattoos or multiple-session projects, each session may require its own deposit.
Studio Environment
All tattooing is performed in a communal studio space. We do not offer private rooms.
We strive to maintain a safe, inclusive, and respectful environment for all clients and staff. Harassment, discrimination, or abusive behavior will not be tolerated.
Medical and Liability Consent
Before your tattoo, you must complete and sign a medical and liability consent form, accurately disclosing any health conditions, allergies, medications, or skin sensitivities.
We reserve the right to refuse or postpone service if we believe that proceeding may compromise your health or safety.
Design and Stencil Approval
We will collaborate with you to create a custom tattoo design. All designs remain the intellectual property of Ink By Jay, unless otherwise agreed in writing.
You are responsible for approving the final design and stencil placement before tattooing begins. Once tattooing starts, no further design changes can be made. We are not responsible for concerns that could have been addressed prior to beginning the procedure.
Payment and Pricing
Full payment is due upon completion of your tattoo.
Pricing is based on design complexity, size, placement, and artist expertise, and may change if your design or session requirements change. Initial quotes are estimates only; final costs may vary.
Aftercare
We will provide you with detailed aftercare instructions to promote proper healing. You are responsible for following these instructions.
We are not liable for infections, fading, or other complications resulting from failure to follow aftercare advice or from your personal healing process.
Aftercare products may be available for purchase at the studio.
Refusal of Service and Conduct
We reserve the right to refuse or discontinue service for reasons including (but not limited to):
Intoxication or drug use
Abusive, threatening, or inappropriate behavior
Health or safety concerns
Failure to comply with studio policies or consent requirements
All clients and staff are expected to treat one another with respect.
Liability and Acknowledgment of Risk
You acknowledge that tattooing involves inherent risks, including but not limited to:
Infection
Allergic reaction
Scarring
Uneven healing or fading
Variations in color or design
You understand that tattoos are permanent and that removal or alteration may require laser or surgical procedures, which can be expensive and may not fully restore your skin.
By proceeding with your tattoo, you voluntarily assume all associated risks and release Ian Kirkpatrick and any associated artists from liability for complications or dissatisfaction related to your tattoo.
No Refund Policy
All deposits and tattoo payments are non-refundable.
We do not offer refunds or exchanges for tattoos, deposits, or retail product sales.
Changes and Rescheduling
While we make every effort to keep scheduled appointments, unforeseen circumstances (such as illness, emergencies, or equipment issues) may require us to reschedule your appointment.
If this occurs, we will notify you as soon as possible and work with you to find a new appointment time.
Governing Law
These Terms are governed by the laws of the State of Indiana and the federal laws of the United States applicable therein.
Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in the State of Indiana, USA.
